Landmark Ruling: Police Free to Collect DNA/Fingerprints

The Supreme Constitutional Court has ruled that the Police can collect DNA samples and fingerprints from detainees, in accordance with Article 25 of the Police Law (N. 73(I) 2004).

The ruling, issued on September 12, 2025, allows law enforcement authorities to collect measurements, photographs, and fingerprints from persons in lawful custody. The Court examined whether Article 15 of the Constitution, regarding respect for private life, is violated by Article 25 of the Law.

The Court decided that Article 15 allows restrictions on the right to private life through law, provided it serves a legitimate purpose, such as protecting public safety and preventing crime.

The case was handled by lawyers Ms. Polina Efthivoulou, Ms. Christia Kythraiotou, Mr. Vasilis Bissas and Ms. Irakleia Zisimou on behalf of the Attorney General.
