Court Rejects Appeal on Illegal Access to Telecommunications Data

The Supreme Court rejected an application for a writ of Certiorari, by which the applicant sought the annulment of an order from the Limassol District Court (June 25, 2025), which allowed police access to recorded private communications from mobile phones, SIM cards, and a laptop seized during an investigation into serious criminal offenses.

The offenses included cases of terrorism and espionage.

The applicant argued that before the issuance of the order, the investigating authorities had already illegally accessed and processed data from his devices, in violation of the Constitution and the ECHR. The Supreme Court, however, ruled that no such violation was evident from the case material. It found that the initial examination of the evidence was limited to forensic analysis and did not include access to the content of private communication, which took place only after the issuance of the court order, following a request from the Attorney General.

The Court ruled that the warrant met the requirements of the law, as it concerned specific evidence and was limited to data related to a possible risk to the security of the Republic. Therefore, the application was rejected.
