Christmas and New Year's Holiday Pay: What You Need to Know

GSEE provides information regarding the compensation of private sector employees during the mandatory Christmas and New Year's holidays. Mandatory holidays are December 25th and 26th, and January 1st and 6th.
Work Prohibition: On mandatory holidays, the employment of workers and the operation of businesses are prohibited, except for those legally operating on Sundays and holidays. Offsetting a day of rest with a mandatory holiday is not permitted.
Businesses Not Operating: The usual daily wage is paid without premium to those paid by the day. Those paid a salary are not entitled to additional compensation.
Businesses Legally Operating: Employees are entitled to their usual daily wage and a 75% premium calculated on their legal hourly wage for the hours worked. If work exceeds 40 hours, additional compensation is due for overtime.
In case of more favorable terms (e.g., from collective agreements), these prevail.
