Residents Appeal to the Council of State Over Hellenic Project

Eleven residents of Glyfada and Hellenic, along with the "Beautification Cultural, Athletic Association of Residents of Lower Hellenic," have filed an appeal with the Council of State (StE) regarding the Hellenic project.

The appellants are seeking to have the legislative framework and building permits issued for the construction of the skyscraper and other facilities in the Metropolitan Pole of Hellenic – Agios Kosmas declared unconstitutional and illegal.

They are challenging the Deputy Minister of Environment, Presidential Decree 28-2-2018, and a series of building permits. The residents claim that they are directly affected by the project, particularly the separation from the coastal front due to the high-rise buildings.

They point out that the skyscraper under construction violates building regulations, with "extensive deviations." They state that an "average building coefficient" was established by ministerial decisions at levels greater than 0.40, leading to a "dramatic increase in building density."

In the annulment request, the residents, through their lawyer Vasilis Papadimitriou, argue that the maximum permitted height of buildings around the skyscraper is being violated, as well as the building density and volume of all buildings in the exploitation zone.

They also state that the challenged actions lead to urban "fragmentation" of the Development Zone, while the average building coefficient established cannot override the 0.40 coefficient provided by Presidential Decree 28-2-2018.

Finally, they note that issues are being raised regarding alterations to the ground level and violations of restrictions on the maximum permitted height of buildings.
